Renting in Amberleigh

Below is the notice to Owners and Tenants regarding rental of properties within Amberleigh.

AMENDMENT TO MILL CREEK DECLARATION OF RESTRICTIVE COVENANTS

Pursuant to Article 12 of the Mill Creek Declaration of Restrictive Covenants (the "Declaration”) the undersigned, being the President and Secretary of the Mill Creek Community Association, 15714 Country Club Drive, Mill Creek, Washington, formed by the Declaration dated April 21, 1975, recorded as Auditor’s File No. 238420, as amended, do hereby declare that the following Amendment to the Declaration has been approved by a majority of the Board of Directors of Mill Creek Community Association and by the requisite vote of members of the Association voting at the Annual Meeting held on September 25, 2013:

New Section 7.1.10 as follows shall be and hereby is added to the Declaration:

7.1.10  The lease or rental of any Living Unit (including any home, townhome, or condominium) within the Mill Creek Community Association is governed by the Articles of Incorporation, By-Laws, rules, regulations, Restrictive Covenants of the Association, and provisions of RCW 59.18 — Washington Residential Landlord-Tenancy Act.


Obligation of the Owner

It is the duty and responsibility of the Owner to deliver to the Tenant a copy of the rules and regulations of the Association, including the Restrictive Covenants, and to have lease and rental agreements in writing. It is also necessary for the Owner to notify the Association office within 10 calendar days of the signing of a new lease or rental agreement for any new Tenant, and provide all requested information regarding their identity and contact information.  The Owner must also provide information regarding the Owner's whereabouts, email, and telephone information so that they may be easily reached, if necessary.  Owners are also expected to provide the Association with move-in and move-out dates of all Tenants.


Obligations of the Tenant

The Tenant is expected to manage the Property as if they were the Owner, that is, according to and in compliance with the rules, regulations, and Restrictive Covenants of the Association. That duty and responsibility includes the proper maintenance and repair of the home, townhome, or condominium, and the Property.  lf, for any reason, the Tenant fails to live up to their responsibility in the management of the rented dwelling or Property, it is the responsibility of the Owner to correct the situation, including if necessary, maintenance and/or repairs.  Management includes, but is not limited to, regular yard maintenance, proper conduct with and respect for neighbors by Tenants and their guests, the removal of trash totes on time, and the adherence to local City of Mill Creek noise restrictions.


Remedies Available to the Association

The Association shall have, and may exercise, the same rights of enforcement of the rules, regulations, and Restrictive Covenants, and remedies for breach of the Governing Documents, against the Owner when a Property is leased or rented just as though the Owner were in residence.  The Association reserves the right to give notice to any Owner and/or Tenant to immediately cease violations.  lf notified by the board, an Owner shall have the right to be heard by the board.  Any costs or fines incurred as a result of the exercise of these rights, and any remedies that may be required, are solely the Owner’s responsibility, and are due and collectable as outlined within the Governing Documents.
